PRIVACY
Berggi offers unique software that will run on your cell phone and will use your cell phone's Internet connection for you to become a member of Berggi and use the Berggi service.
We provide to our members means to set up their profiles for their personal, group, team, business, organizational and/or affiliations use that can be linked together via cell phones and shared through networks of people from their cell phones and from their computers.
Using their phones or computers Berggi members, may view each others' profiles, folders and files and communicate with friends, peers, co-workers and meet new people who are Berggi users all over the world.
In order to provide a unique Berggi experience for our members, we display some parts of members' personal information if they permit us to do so, to other members, which allows our members to identify each other and expand their network of friends, peers, co-workers and customers. Berggi members can change their profile information at any time and can control how other members and the service communicates with them.
INFORMATION COLLECTION AND USE BY BERGGI
Berggi does NOT give away or sell member information to third party advertisers, marketers, or to third party e-mail or SMS-based product/service promoters.
Berggi collects member submitted information such as cell phone number, e-mail address and name to authenticate members. Berggi also collects other profile data including but not limited to: personal interests, gender, age, education and occupation in order to provide assistance to our members in finding and communicating with each other.
Berggi also logs non-personally-identifiable information such as cell phone settings, IP address, et al., from members to the site. This data is used to manage the improvements for the Berggi services. This non-personally identifiable information may be shared with third-parties that provide services to the members via Berggi user interfaces.
If permitted by the member, member profile information including members' pictures and first names are displayed to other members in order to facilitate member communications and interaction. A Berggi member can select how much of their personal information they will permit to make public for other members to see. At minimum this is NO information. If this is the case no Berggi member can find him/her unless the member specifically tells his/her presence to other members he/she selects. To facilitate searching and finding people world-wide who are Berggi members, Berggi allows users to search for other members using telephone number, e-mail address, name et al.
Berggi uses members' e-mail address or phone number to send updates and news regarding the service. From time to time, Berggi may sponsor a promotion, sweepstake or contest on Berggi. Members may be asked to provide personal information including name, e-mail address or home address or to answer questions in order to participate.
Berggi will store member information for as long as is necessary to: (1) perform the Berggi service; (2) invoice for fee based services and maintain records until invoicing for the fee based services cannot be lawfully challenged and legal proceedings may no longer be pursued; (3) carry out Berggi marketing activities; (4) comply with applicable legislation, regulatory requests and relevant orders from competent courts; (5) enforce our Terms of Service; or (6) fulfill any of the other purposes detailed in this privacy statement.
INVITATIONS
Berggi members can invite other people who are not using Berggi to join the service by sending invitations provided by Berggi automated invitation features. The Berggi system stores the e-mail addresses or telephone numbers of the invited to be able to recognize a new member joining in due to an invitation. Berggi members may also store phone numbers and e-mail addresses of people they know in their Berggi contact lists and may also choose to send invitations and engage in messaging with those numbers and addresses.
COOKIES
Berggi cell services DOES NOT use cookies in their members' phones. Berggi software downloaded by a Berggi member with their free will does not contain cookies or hidden links to other third party sites.
Berggi uses cookies in its Web site to store Berggi member's preferences in using Berggi Web-interface, such as to record session information, for purposes in personalization. Berggi does not link the information Berggi stores in cookies to any personally identifiable information our members submit while they are on our site.
Berggi members can configure their Web browsers (not a part of Berggi offer) to accept or reject all or some cookies.
LINKS
Berggi on members' phone do not contain any visible or hidden links to other third party cell or Web sites. Berggi members may select at their own will such links from Berggi ShortCuts library (this service is not active at the moment).
Berggi Web site contains links to other Web sites. Berggi is not responsible for the privacy policies and/or practices on other sites. When linking to another site a user should read the privacy policy stated on that site. Our privacy policy only governs information collected on Berggi.
CONTENT OF MESSAGES AND MEMBER INFORMATION
Berggi members bear the sole legal, commercial, ethical or moral responsibility and implications of the contents of the messages they sent or receive, and information they exchange and share with other Berggi members or with other people who are not Berggi members.
MAKING YOUR INFORMATION ACCESSIBLE TO OTHER BERGGI MEMBERS
If a Berggi member chooses to share some/all of his/her information with other Berggi members, those members need to know whenever others access that information.
MODIFYING OR REMOVING MEMBER INFORMATION
Berggi members may modify or remove any of their information at any time by logging into their account.
SECURITY
Berggi member accounts are secured by member-created passwords. Berggi takes precautions to insure that member account information is kept private. We use reasonable measures to protect member information that is stored within our database, and we restrict access to member information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. Please note that we cannot guarantee the security of member account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of member information at any time.
SHARING AND DISCLOSURE OF INFORMATION THAT BERGGI COLLECTS
Except as otherwise described in this privacy statement, Berggi will not disclose personal information to any third party unless we believe that disclosure is necessary: (1) to protect the safety of our members; (2) to enforce the Berggi Terms of Use agreement or to protect our rights; or (3) to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by Berggi, whether or not a response is required by applicable law. Berggi reserves the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of Berggi or substantially all of its assets to that successor in interest. CHANGES IN OUR PRIVACY POLICY
From time to time we may make changes to our privacy policy. If we make changes, we will post them on our site to make users aware of what the changes are so users will always be aware of what information we collect, how we use it, and when we may disclose it. A member is bound by any minor changes to the policy when she or he uses the service, including Berggi Web sites, after those changes have been posted. If however, we are going to use members' personally identifiable information in a manner materially different from that stated at the time of collection we will notify by posting a notice on our Web site for 30 days.
